You book your group at a local nightclub. Your lead vocalist gets strep throat and cannot sing that night. The nightclub owner demands money from YOU because nobody showed up for the show. IF YOU HAD A CONTRACT: If you signed a contract with the nightclub owner, there would be a contingency clause regarding illness or other matters beyond your control and (check this out!) the nightclub owner may owe YOU money!
Producer Dr Dre was sued by Indian composer Bappi Lahiri, who filed the $500 million lawsuit last year for the alleged sampling of his song, "Thoda Resham Lagta Hai" on Truth Hurts hit single [Addictive]. A Los Angeles judge ordered that that the song be prohibited from further sale until Lahiri is properly credited for his sampled work. Interscope and parent company Universal Music are expected to appeal the decisions but a date has yet to be set, although a date for Lahiris lawsuit has been set. IF THEY USED A CONTRACT: Dr. Dre would not be in this predicament had he protected his company by signing a contract with the music producer who may in fact be taking this grand opportunity to make a few extra bucks from the record label.
TESTIMONY: I can't name names, unfortunately. as is the norm, I've been swindled many times, mostly by so-called "indie" labels, which is very sad. but the biscuit-taking moment has got to be finding out last year that a goodish proportion of my '90s publishing was spirited away by a crook who bought off my rights from himself (too long to explain how -- but he could), then declared himself bankrupt -- but only after assigning these rights to another of his companies -- then selling them on to a brazilian (!!!) company which has never, ever sent any accounts to me. it's all now in the hands of my noble publishers mute song. IF YOU HAD A CONTRACT: If you had our publishing contract with sale and distribution clause, you would be protected from this situation.
You are promised (a verbal declaration) a piece of the family property (a three bedroom, two bathroom house in suburban Los Angeles, California) but you must graduate from college in order to have the house grant deeded to you. You graduate from college, a big party is thrown in your honor, and the house is promised again. Then a couple of months after graduation the family member that promised the house to you gets upset, changes their mind and breaks their promise. You end up in a crummy apartment. IF YOU HAD A CONTRACT: If you had a real estate (grant deed) contract signed and promised to you at the graduation party, you could be relaxing in your very own backyard! | |
